If the government continues to flip-flop on foreign investment regulations, a lot of foreign property investors will either move back home or to areas they are comfortable with, says Stephen O'Brien, a real estate veteran who is moving to Dubai after being in Bangkok and Phuket for several years. Investors would prefer to be in countries where they can wake up one morning and not find that key legislation is being changed without public consultation, he said. "I think that if you're going to spook the market and people are going to get too concerned about what's happening, they'll just go back to what they know." The investment shift is unlikely to be to other Southeast Asian countries, how ever. Mr O'Brien notes that Bali attracted a large inflow of foreign property buyers, many of whom stayed on after the first major bombing in October 2002 but pulled out after the second one in 2005. "You're starting to see a very aggressive campaign in various Australian states urging people to stay at home and travel within their own country," he said. Foreign property buyers could easily go elsewhere because they have the money and the willingness to invest but they don't want obstacles, he said. "You put one obstacle in, okay, your lawyer can work around it, but when you put up a dozen obstacles it just becomes impossible to manoeuvre your way to the finishing line." Mr O'Brien believes that buyers of million-dollar villas in Phuket have probably been talking to their lawyers and financial advisers in their home countries, and they could be warning their clients to be cautious. "I know people here-farangs and expats who have money, just basically savings money, and they're scared what's going to happen to it. Will the government change its mind and suddenly all foreign accounts in the banks are frozen? "That's bizarre thinking but people are afraid of that. That's the extreme but that's what people are thinking because it's so easy now to change things-what's going to happen in the next five years?" Despite these fears, Mr O'Brien does not see panic gripping the resort property market, barring further surprises or flip-flops from the military-installed government. "Are there going to be bargains in the market? I don't think so. We were all expecting the bargain-hunters to come in for fire sales after the tsunami but in fact the reverse happened-prices increased." Mr O'Brien, who headed the Phuket office of the agency Knight Frank for four years, noted that while discounting has not taken place in Phuket over the last three to four months, there has been a slowdown. However, this could be because there are now more real estate agents on the island. What is upsetting the market is that in other countries, major amendments to key legislation such as the Foreign Business Act would normally be subject to a lengthy public consultation process and not be implemented overnight. "In all honesty I think the days of owning freehold villas, no matter whether this corrects itself when the next government comes in and opens [the market] up again, I just think those days are gone," he said. "We've seen over the last six months that the goalposts can move and I think that's going to throw an incredible amount of foreign business out of the door." Mr O'Brien also laments the fact that there is no strong advocate for real-estate agents in Thailand. "We needed a strong body to actually lobby the government from time to time about these changes and what the implications are; we never saw that." A comparison can be drawn with Dubai where Mr O'Brien is now headed. The government there offers an easy step-by-step process for foreigners to invest with a clear objective of turning the Emirate into the gateway of the Middle East, a place to do business, holiday and retire. "They actually encourage foreign investment, regardless of whether you are a foreigner living in Iran, America, Australia or London. If you actually buy property you get residency, there are no questions asked. You can come and go, you can get freehold, you can get leasehold, so it's a very easy way. It's what people are comfortable with and accustomed to. "What we're going through at the moment, all this uncertainty in the way foreigners can invest from massive corporations-the Coca-Colas of the world-to the moms and dads. And then you have the structure-no financing available in this market. You have the visa stage-even that is becoming very complex and difficult. There are just so many obstacles in the way. It just becomes very cumbersome to invest." Mr O'Brien pointed to the Australian model for handling foreign real estate investment. The foreign investment review board is quite rigorous and the approval process is lengthy, and the foreigner buying has to demonstrate intentions for buying parcels of land. But the rules are clear and unambiguous nonetheless. "It was basically aimed at stopping the Japanese who back in the early 1990s were just buying up most of Australia," he explained. "So there are models that can actually simplify and welcome foreign investment in the country." However, despite these issues Mr O'Brien does expect the resort market to pick up once there is a bit more clarity about investing in Thailand. "Typically there will be a slowdown until there is a clear policy direction and then it will pick up again very quickly."

When any victim (user of such material) goes through such study materials and courses as well as certifications, they become helpless to understand such complicated and misguiding language, filled up of useless and non-understandable technical terms. Why offshore asset protection (aka Foreign Asset Protection) is good?

The U.S. Taxpayer has been intimidated by the government, accountants, and lawyers into equating offshore or foreign business asset protection as fraudulent, unlawful illicit activities and as hiding their assets, fortunes and money illegally. The foreign countries take the opposite point of view that doing business with U.S. citizens is not worth their time and effort because it subjects them to too many restrictions and over reporting to too many agencies.

For example, the United States Congress since the year 2000 has added some 20,000 pages of new tax-law regulations and increased the number of 1040 forms (individual income tax return) reporting and compliance requirement from 475 to 582. Americans spend on average 26 hours and spend in excess of $140 billion in tax preparation and compliance, each year. The laws are so complex that 60% of Americans have to hire professional help.

Foreigners avoid doing business with US citizens because they don't want to be dragged into a myriad of compliance. Why are there so many lawyers like coffee shops around every corner?

Mention the word "Offshore" and I will lose 98% of the people. The perception of "offshore" is that it's a less than credible type planning. Have you noticed that no U.S.-based newspaper has any bank certificate deposit offers or information about bank certificate deposits? There is only mention of U.S.-based investment opportunities. So how do non-U.S. citizens make their money? Is America the only country that has and created this impeccable knowledge of business and commerce?

More to the point, nothing about foreign commerce is being taught in our colleges - nothing truly worthwhile that is of pragmatic significance anyway. In a shrinking global economy and internet-based worldwide commerce, the lack of information on international commerce is bewildering.

Even of a certain well respected business college where I'm a graduate of and where the composition of foreign students to U.S. students are about 65% from outside the United States, the professors have the word "International" on their business cards; yet when quizzed about how to conduct business in a foreign country, their stock answer is that I should consult with my accountant or lawyer. To which I respond, so you've never conducted business outside the U.S.? Have you ever been outside the U. S.?

So the word "International" on your business card does not refer that you're an expert "professor" of international trade, but that you mean to refer to your business card is that you teach international students out of a textbook but without first-hand experience in international business. You guessed it. They walk away but this is true of any person who has been intimidated by the present business realm and in particular the offshore governing structures.

OFFSHORE ASSET PROTECTION IS WICKED
There seems to be a sentiment among the "international" professors the word "offshore" is synonymous with wickedness probably propagated by the government or more due to their lack of knowledge of the complexities of offshore asset protection. It is not for the faint of heart.

Most people mistakenly believe that foreign tax planning is for the very rich. It is not only for the wealthy. As individuals become financially sound, 10% to 15% of their assets should be offshore. It's a legitimate business necessity. In the event of catastrophic events or major calamity, whether from personal origins or business related ones, you should be able to get your hands on some cash that is outside the United States. Is it not the principle that all your eggs should not be in one basket the primary goal of sound investments?

So what's offshore asset protection? What's involved in it? Is offshore asset protection appropriate for everyone? What's this intimidation factor all about?

1040 INCOME TAX RETURN REPORTING IN OFFSHORE ASSET PROTECTION
The intimidation part the problem stems from the form 1040 income tax return schedule B, Line 7a where you must the check the box if at any time during the taxable year you had an interest or a signature or other authority over a financial account in a foreign country, such as a bank account, securities account, or other financial account. If the answer is yes, you have to file an additional form "TD F 90-22-1". Answer "Yes". Check the box. It's not a crime to have a foreign bank account or hold foreign securities.

Additionally question 8 of form 1040 Schedule B, asks if you received a distribution from, or were the grantor of, or a transferor to, a foreign trust. Answer "Yes". It's not a crime to have a Foreign Asset Protection Trust (FAPT).

DOING BUSINESS OFFSHORE WILL NOT TRIGGER AN AUDIT BY THE IRS
It's not a crime to do business internationally or offshore. The U.S. treasury (aka IRS) is more concerned if you do not report. Reporting business transactions is as with any U.S.-based reporting whereby we, the taxpayers, report all income, interest, dividends and other sources of income from all sources on a worldwide basis.

Doing business internationally and checking the box on schedule B will not trigger an audit. The sole purpose of doing business internationally is to access business opportunities on a worldwide basis and bulletproof foreign asset protection or better known herein as offshore asset protection.

But, on the other hand there is a fact also that very few peoples know anything in-depth about the topic of hacking and information security. So, I would suggest that without adequate knowledge please do not get mad behind passion. Sometimes this passion may become dangerous from the legal point of view. There is nothing wrong to gain expertise, but there is need to realize a fact about incorrect issues behind hacking. I will come to this topic in depth, later in the same chapter.

Be Alert and Aware: Do you think that hacking is an expert level work? Do you think that information security and hacking are one and same things? If yes! Then you are absolutely wrong. Many children in the age group of 14-16 years are having sufficient knowledge to hack any website or collect important data facts from the internet. So, internet being the big source of information it's a child game to perform hacking related activities. Many hackers whose aim is to just earn money from you, they give seminars and workshops along with misguide you that, "learn hacking in an ethical way for a brilliant career". But, I am not going to explain in this way, to any of you. Instead, I would like to explain the fact in a positive way with a positive attitude. A teacher's task is to show right path to students and not misguide them for gaining their personal benefits. So I would suggest that instead of going for the knowledge of hacking, gain the knowledge by learning something, which is said to be an expert level job. And this expert level job is known as information security expertise in technical terms. Hope you might have understood the difference between hacking (not expert level job) and information security (expert level job) from this topic. So, be alert from such misguidance.

Other then passion, one more side of coin also exists. Many institutes and independent peoples call themselves hacker and/or information security experts. But the reality behind their expertise and skills gets displayed in front of non-technical peoples and the victims who undergo for training, courses, certifications, seminars and workshop with such types of self-claimed hackers or institutes, when such victims and non-technical peoples realize that they are not satisfied for which they have spent time and money. The actual reality behind fooling is that the peoples who undergo for such seminars, workshops, courses, etc. most probably undergo through a psychology that, "the person or institute from which we will receive knowledge during the training sessions is an expert or is providing quality education as he was published by media agencies or that it's a branded name in market for related subject talent or that he is an author of any book". I believe in practical, official and those tasks or actions for which evidence lies in front of my eyes. Thus, I am trying to explain to everyone that always be alert and aware, so that your hardly earned income does not get spend in such unnecessary waste of time.

I will give you my own example here! I have several articles about me in various newspapers and media agencies, but this doesn't mean that I am showing you the right path or that I am an expert. For example may be possible that I am a hacker, but this does not prove that I am an expert. So, expert level job is a totally different matter. The explanation about difference between hacking and expertise will come in next chapters So, first check out the level of my knowledge, how much practically I am able to prove my expertise, whether I am official & legal while undergoing for such tasks and finally the evidence part that whatever actions I undertake are proved right in front of eyes, instead of just talking theoretically. Always confirm yourself first, that you are learning with right person or institute or just wasting your time and money. May be possible that peoples might be receiving fees from you and in turn give you the knowledge of something(any other subject or topic about information technology field), which is not even single percent part of hacking or information security related topics. This happens most probably with non-technical peoples or fresher in information technology field.

False Publicity: Secondly, confirm that you are at least gaining the knowledge up to a level for which you have paid a particular amount. Don't just go behind false publicities before you confirm yourself and your inner feelings say that you are moving on right path. As concerns to book publishers, media agencies and films, I would like to confirm that none of them might be having full and fledge technical knowledge about information security field as concerns to my knowledge. It's similar to following examples on me:

A person comes and tells me that you are an expert please suggest me some medicines which can eradicate my serious disease of cancer. I am a technical professional and not a biological professional who is going to solve this problem. A person comes and tells me that suggest a good lawyer who can defend my case in court. Now tell me how do I give suggestion as to which lawyer can prove this person innocent in court of law. Thus, I can't do anything or have any knowledge about any field which is not my subject or area of work. Similarly, even media peoples, book publishers and film makers does not have adequate or complete knowledge and they believe the statement to be true which is explained to them by many misguiding self-claimed hackers and/or reputed institutes. So, these peoples are also not responsible for some of these kinds of activities published by them on any medium.

Language Troubling: There is one more part of cheating called use of useless and complicated language in order to misguide students and especially technically sound professionals. This is a very intelligent part of stunt used by many self claimed security peoples to misguide others. Usually when any self claimed hacker or institute doesn't know anything about complicated or expert level topic, and in such situation they want to include expert level topics in their study material without having any expert level knowledge; such peoples use very complicated words of English and prepare the contents in such a manner that it becomes very difficult to understand even for the persons who are fluent in English. A very complicated coding and useless technical terms are used in their study material, so that the victims cannot understand or claim against such self claimed hackers and so called specialized institutes, in a legal way. When any victim (user of such material) goes through such study materials and courses as well as certifications, they become helpless to understand such complicated and misguiding language, filled up of useless and non-understandable technical terms. Now, when they don't understand anything the common psychology of such victims understands that, "it's a part of expert level work and that's why they are unable to understand the matter or that he won't be able to complete this job successfully as he is not talented" and so on. In this way, the victims think themselves responsible for not understanding the expert level work. But they do not know that they have never been taught anything, which can be called an expert level education or job. This is what I am trying to explain you that it is not your fault, instead it is a stunt used by such self claimed hackers and institutes who tries to sell their services and materials by misguiding others with the help of language troubling. So here also there is a need to be aware and alert of any services or material offered by any self claimed hacker and specialized institutions. They just have an intention of earning a huge amount from you and do not have any feelings for the information security field, students or the nation in any way. This is the reason they use difficult word, complicated terms and technical coding in order misguide others so that no one knows about their level of their knowledge.

Finally: Thus, finally the topics should be very clear that

Check the simplification of language used in the study material whether you can go through it and understand it or not, before purchasing any services or materials from self claimed hackers or so called expert level institutes which claims to be specialized in information security area. Try to understand the difference between a truth and a false, correct and incorrect, etc. by going in depth about every fact related to services, products or materials you are offered by any self claimed hacker or so called specialized institutes. Even if this is in my case, first check out with my study material, then get into the depth of my work background and then only purchase any services, products or material offered by me or on behalf of me. Don't get misguided behind media hype or false publicity of any person or institute without checking through it.

Hacking and hackers

Passion or Madness: Now days, it has become a passion to learn about hacking and information security. Sometimes I do not understand that whether it is a passion or a kind of madness. This passion has resulted due to several news articles, media stories and the excitement showing hacking related thrills in films. But, on the other hand there is a fact also that very few peoples know anything in-depth about the topic of hacking and information security. So, I would suggest that without adequate knowledge please do not get mad behind passion. Sometimes this passion may become dangerous from the legal point of view. There is nothing wrong to gain expertise, but there is need to realize a fact about incorrect issues behind hacking. I will come to this topic in depth, later in the same chapter.

Be Alert and Aware: Do you think that hacking is an expert level work? Do you think that information security and hacking are one and same things? If yes! Then you are absolutely wrong. Many children in the age group of 14-16 years are having sufficient knowledge to hack any website or collect important data facts from the internet. So, internet being the big source of information it's a child game to perform hacking related activities. Many hackers whose aim is to just earn money from you, they give seminars and workshops along with misguide you that, "learn hacking in an ethical way for a brilliant career". But, I am not going to explain in this way, to any of you. Instead, I would like to explain the fact in a positive way with a positive attitude. A teacher's task is to show right path to students and not misguide them for gaining their personal benefits. So I would suggest that instead of going for the knowledge of hacking, gain the knowledge by learning something, which is said to be an expert level job. And this expert level job is known as information security expertise in technical terms. Hope you might have understood the difference between hacking (not expert level job) and information security (expert level job) from this topic. So, be alert from such misguidance.

Other then passion, one more side of coin also exists. Many institutes and independent peoples call themselves hacker and/or information security experts. But the reality behind their expertise and skills gets displayed in front of non-technical peoples and the victims who undergo for training, courses, certifications, seminars and workshop with such types of self-claimed hackers or institutes, when such victims and non-technical peoples realize that they are not satisfied for which they have spent time and money. The actual reality behind fooling is that the peoples who undergo for such seminars, workshops, courses, etc. most probably undergo through a psychology that, "the person or institute from which we will receive knowledge during the training sessions is an expert or is providing quality education as he was published by media agencies or that it's a branded name in market for related subject talent or that he is an author of any book". I believe in practical, official and those tasks or actions for which evidence lies in front of my eyes. Thus, I am trying to explain to everyone that always be alert and aware, so that your hardly earned income does not get spend in such unnecessary waste of time.

I will give you my own example here! I have several articles about me in various newspapers and media agencies, but this doesn't mean that I am showing you the right path or that I am an expert. For example may be possible that I am a hacker, but this does not prove that I am an expert. So, expert level job is a totally different matter. The explanation about difference between hacking and expertise will come in next chapters So, first check out the level of my knowledge, how much practically I am able to prove my expertise, whether I am official & legal while undergoing for such tasks and finally the evidence part that whatever actions I undertake are proved right in front of eyes, instead of just talking theoretically. Always confirm yourself first, that you are learning with right person or institute or just wasting your time and money. May be possible that peoples might be receiving fees from you and in turn give you the knowledge of something(any other subject or topic about information technology field), which is not even single percent part of hacking or information security related topics. This happens most probably with non-technical peoples or fresher in information technology field.

False Publicity: Secondly, confirm that you are at least gaining the knowledge up to a level for which you have paid a particular amount. Don't just go behind false publicities before you confirm yourself and your inner feelings say that you are moving on right path. As concerns to book publishers, media agencies and films, I would like to confirm that none of them might be having full and fledge technical knowledge about information security field as concerns to my knowledge. It's similar to following examples on me:

A person comes and tells me that you are an expert please suggest me some medicines which can eradicate my serious disease of cancer. I am a technical professional and not a biological professional who is going to solve this problem. A person comes and tells me that suggest a good lawyer who can defend my case in court. Now tell me how do I give suggestion as to which lawyer can prove this person innocent in court of law. Thus, I can't do anything or have any knowledge about any field which is not my subject or area of work. Similarly, even media peoples, book publishers and film makers does not have adequate or complete knowledge and they believe the statement to be true which is explained to them by many misguiding self-claimed hackers and/or reputed institutes. So, these peoples are also not responsible for some of these kinds of activities published by them on any medium.

Language Troubling: There is one more part of cheating called use of useless and complicated language in order to misguide students and especially technically sound professionals. This is a very intelligent part of stunt used by many self claimed security peoples to misguide others. Usually when any self claimed hacker or institute doesn't know anything about complicated or expert level topic, and in such situation they want to include expert level topics in their study material without having any expert level knowledge; such peoples use very complicated words of English and prepare the contents in such a manner that it becomes very difficult to understand even for the persons who are fluent in English. A very complicated coding and useless technical terms are used in their study material, so that the victims cannot understand or claim against such self claimed hackers and so called specialized institutes, in a legal way. When any victim (user of such material) goes through such study materials and courses as well as certifications, they become helpless to understand such complicated and misguiding language, filled up of useless and non-understandable technical terms. Now, when they don't understand anything the common psychology of such victims understands that, "it's a part of expert level work and that's why they are unable to understand the matter or that he won't be able to complete this job successfully as he is not talented" and so on. In this way, the victims think themselves responsible for not understanding the expert level work.
