Understanding Rattlesnake Bites

However, like other animals, they strike when cornered, threatened or provoked.

In California, rattlesnakes can be found just about anywhere. However, the California Poison Control Center noted that rattlesnakes account for only 800 of the 8,000 stated bites in the country. Hence, the prospect of rattlesnakes wandering anywhere in California, should not deter you from enjoying running, hiking or doing activities outdoors. You just need to use ordinary caution in order to avoid rattlesnake bites while enjoying the sun.

If you want to hike, wear over-the-ankle boots and loose fitting pants to protect you from injuries caused by accidental rattlesnake bites. Also, walk along well-used trails and refrain from walking alone and wandering away from the trail.

On the other hand, to protect yourself from rattlesnakes while in the comfort of your own home try to remember that the best thing you can do to keep the rattlesnakes away from your garden, garage or inside your home is to put up a rattlesnake proof fence. Also, you should trim vegetation and brush near your fence. Similarly, make sure that you clear your area from piles of board, wood, rocks or anything that would make a damp, dark and cold space for rattlesnakes to hide.

If in the remote possibility that you get bitten by a rattlesnake. Do not panic and stay calm. For adults, the most serious effects of a rattlesnake bite is usually local tissue damage only which can be treated. It is a different story however for children who are obviously susceptible to more serious injuries.

If you have been bitten by a rattlesnake, call 911 immediately. Calmly narrate what happened and the injury you suffered as well as the place where you got bit by the rattlesnake. If, in case you are able to drive, immediately go to your doctor for treatments but refrain from panicking. Driving at high speeds could get you into more serious trouble than a rattlesnake bite.

In case the rattlesnake is a kept snake, seek the services of an expert lawyer. You may be entitled to damages as a result of the negligence of the owner or keeper of the rattlesnake.

Floods causing road traffic accidents

The chances of (rta) road traffic accidents happening are greatly increased when we have more rain than normal. When our roads have been dry for some time and then suddenly the heavens open and the rain comes down, this can make driving conditions seriously impaired.

Tarmac becomes almost as slippery as ice when water hits it after a period of dry and warm weather. It only takes driving a little too fast around a roundabout or turning in general when if the ground is seriously slipping you can loose control and skid across the road.

Since the rain began there have been numerous occasions where people have been late to work due to accidents on the road or been involved in an road traffic accident themselves.

Having a road traffic accident can be quite a scary experience. Loosing control of a vehicle where you spin out into the path of on coming traffic is every driver’s worst nightmare.

You might think that if an accident occurs due to the natural weather conditions even if they are extreme then its no-ones fault except Mother Nature or climate change. This is true to some degree but if a river bursts its bank or a bridge collapse then it is the council’s responsibility. If you had a road traffic accident and it was because of extreme water on roads or because you tried to avoid hitting another vehicle that had lost is grip then you could be entitled to claim compensation for any pain and suffering. Claim compensation for accidents that were not our own fault is our civil and legal right. It is not fair for a person who has to find the cost of having weeks of work, repairs to their car all due to a road traffic accident.

There appears to be a stigma attached to claiming compensation. A lot of people think it’s reserved for the lower classes if you don’t mind me using the old fashioned class system. This is so not true. People are also put off by what they think is a complex financial and legal process. The truth of the matter is that claiming compensation for say a road traffic accident is a simple and painless process. All it takes is a call to an Accident Claims firm to start the ball rolling.

They will then send you a form or questionnaire to fill out. Once you have filled in the form you can sit back and let your Lawyer do all the hard work. You will not have to pay a penny towards this law suit as most Lawyers work on a “No Win No Fee” basis which means they wont take the case on unless they are 99% sure they will win. The fees of the Lawyer will be paid once the case has been won. If for some reason the case is lost then the fees of the Lawyer will be paid by “after the event insurance”. This really is a painless way of claiming for compensation for a accident that was not your fault.

So if the floods have caused you to have an accident, don’t think there is nothing you can do about it, call a Lawyer and see what they have to say. Remember if you do or say nothing then the same accident could happen again to someone else. But if you make a stand and seek compensation then those that were responsible will do more to protect people the next time we have flood warnings.

Aviation Insurance A Must for Private Plane Owners

Aviation accidents are serious accidents, especially those that happen while the plane is in flight. Aviation or plane accidents do not only mean pilot error. It could also be caused by malfunctioning gauges as a result of product liability or failure of maintenance.

Also, aviation accidents do not only connote plane crashes or mishaps. Particularly in California, any injury suffered by a person while inside the plane is considered aviation accident. Examples of these accidents are slip and fall, trip and fall, product liability and general negligence.

There is a difference between owner-operators and purely owners of planes in relation to aviation accident liability. If you are an owner-operator or even just an operator of a private plane, if a person is injured inside your plane and there is negligence, you will definitely be exposed to liability. In most states, if the owner of the plane is not piloting his plane at the time of the accident, so long as he can prove that there was no negligence on his part for hiring the pilot, the pilot himself will be liable. In a nutshell, the rule is the one in control of the plane is the one liable in case of injuries to passengers and persons.

If you are an operator of a private plane, you should secure plenty of aviation insurance to protect you from personal exposure in case of an aviation accident. There are insurance providers that do not only insure you against injury claims and damage to properties but also pay for defense lawyers who will defend you against claims, especially if you are not actually negligent.

However, pilots should not be disheartened. In case of accidents, it is seldom that pilots are sued in their personal capacity and against their personal estates. Claimants and their lawyers are aware that it would be a better course of action to go against the employer or the owners of the planes rather than the pilots who are strictly just employees. Personal injury lawyers know that they could get better results if they claim from the owners of the planes who have deeper coffers.

Being a pilot is a great thing. It is a good feeling to fly in the sky and control the huge mechanical beasts that glide the airways. However, such power and freedom is also associated with accountability. It is wise to get aviation liability insurance because an aviation accident can really be life changing.

Bicycle Ouch Memories

Bicycles are part of our childhood memories. There are vivid moments from the time you first saw your new bike up to the time you are learning your first rides on the bike with your family cheering you on.

From playing around, exercising or making new friends, bicycles always have been a part of our lives. However, don’t forget that aside from fond memories, we also have memories of getting hurt by bike accidents. Almost everybody who rode a bike has been involved in one form of bicycle accident or another.

Whether you are an adult bicycle enthusiast or you have young ones who are fond of riding bikes, the single most common protection for bike riders in case of accident is wearing a helmet. Elbow and knee pads are great also but head injuries and brain injuries are more serious injuries than broken bones or bruised skin. Thousands of children are treated each year for bicycle accidents. Also, it is reported that 36 percent of bicycle versus car accidents involved children who are under 14 years old.

Although there are helmets and protective gears to help you avoid sustaining serious injuries from bicycle accidents, it is still a better precaution to avoid getting hit by a car. There are simple ways in order to prevent or minimize your chances of getting hit by a car and having that bicycle ouch memories.

One way to prevent accident is to get a headlight or put reflectors on your bike. Even during the day, bicycles are less visible because of the small frame of the bike. Drivers of automobiles are more wary of other cars on the road. Reflectors and headlights will make you more visible to other motorists.

Another way is to have a horn and honk it. Honking your horn will notify pedestrians and cars of your presence. Also, do not drives fast, swerving everywhere? It is hard enough for cars to see you even when you are traveling alongside cars. It is more difficult to spot you if you just dart in and out of lanes.

In the end, always put in mind that you are invisible to traffic. So long as you think that everybody can’t see you and will bump you unintentionally, your defensive driving to avoid every possible instance of an accident could just save you and others from a lot of harm.

A Contract Set in Stone

The law on obligations and contracts is simple, it states that provided that all the essential and formal requisites of a contract have been complied with, then such agreement or covenant is considered as law between the parties, and no signatory to such a pact may be absolved from the performance of his or her obligation unless the interest of justice and fair play requires.

To put it more blatantly, a contract is an agreement entered into by two or more parties having the ample personality, capacity, and eligibility to contract, and upon finding that the subject of such agreement is well within the confines set forth by our laws, and public policy, then any provision, obligation, or duty incumbent upon any party to perform must be complied with in good faith. If a party’s act runs counter to any of said lawful provision, then a cause of action for breach of contract is available to the other party.

Breach of Contract is a serious malfeasance; it is as though not complying with a rule of law set forth, the only difference is that it is a law brought about by the agreement of the parties and the one that governs only parties thereto. Notwithstanding the same, non-compliance of any provision thereof would actually lead to causes of action ranging from restitution and reparation to payment of damages caused by non-performance.

The rule on proximity of contracts has been applied in breach of contract cases to the letter. This doctrine provides that only those who are signatories to a contract and their successors in interest are liable for any penalty brought about by the non-performance of the obligation. Consequently, the proximity of contracts also provides that only a signatory to the contract or any successor in interest have the ample right to file any claim against another party for non-compliance of his or her obligation. Any third party, who would like his or her right be promote cannot act on the basis of a contract to which he or she is not a party. His or her remedy lies on some other provision of law but not the contract for which he or she was in no way part.

Breach of Contract has several repercussions. Not only would the person be liable civilly for all the damages brought about by non-performance of an obligation, this may also lead to some other effects to include, rescission of the contract, restitution of what has been given by the party who complied with his obligation, or both, and in the said instance damages would also concur.
