By 2002 Neurontin was a $2 billion dollar drug, outselling even Viagra. How did a little epilepsy drug come to claim such a huge number of patients? It did so illicitly.

There are not enough patients suffering from epilepsy that one drug could earn profits of $2 billion a year. In order to claim these kinds of profits, Warner-Lambert began promoting the drug for off-label uses. The company sent representatives directly to doctors, urging them to prescribe Neurontin for to treat not only epilepsy but also bipolar disorder, alcohol withdrawal, cocaine abuse, HIV/AIDS neuropathy, phantom limb pain, anxiety, and a host of other diverse and unrelated conditions.

Though it has since been shown to work for some of these conditions, it was not clear at the time exactly what Neurontin did. The Warner-Lambert salesmen were lying to doctors about what Neurontin could do, and the doctors were listening. While it is illegal for a drug company to promote off-label uses directly and immoral to bribe doctors into prescribing a certain drug, it was also absolutely dangerous to claim Neurontin could cure disorders that it simply couldn’t.

For example, Neurontin has no effect on bipolar disorder. Warner-Lambert sold thousands of doctors on the idea that Neurontin should be prescribed for bipolar disorder. If it did not work, they suggested increasing the dosage. One of the drug company managers told a salesman: “I don’t want to see a single patient coming off Neurontin before they’ve been up to at least 4,800 milligrams a day. I don’t want to hear that safety crap either.... It’s a great drug.” An untold number of bipolar patients were taken off their FDA-approved medication and prescribed Neurontin alone. Although Neurontin has few side effects, it also did nothing for their disorder, leaving these patients effectively unmedicated. Nobody knows how many lives were shattered as a result, but unmedicated bipolar disorder has a mortality rate of 55-60%.

Luckily for the public and patients taking Neurontin, a Warner-Lambert sales representative came forward and revealed the entire scandal. Pfizer has now purchased the Warner-Lambert Company, making Pfizer responsible for the injuries caused by the drug it now profits from. The new rules announced on 9th October 2007 by Alistair Darling allow couples to combine their inheritance tax allowances. Yet it has always been possible for couples to do this providing they had the right wills in place. There are estimates that this reform is going to cost the Government up to £1 billion in lost revenues.

Isn’t it a scandal that prior to pressure arising from recent opinion polls, the Government was happy to collect this much tax from that section of the population that was ill-informed and poorly advised, whilst others with equal wealth could quite legitimately avoid paying up to £120,000 (£300,000 at 40%) in tax.

The chancellor is to be applauded for applying this to widows and widowers (it would have been cruelly unfair not to). Those who have planned efficiently will be unaffected, but a widow with a £600,000 house and only a £300,000 exemption will save £120,000.

The inheritance tax threshold is to rise to £350,000 per person in April 2010, giving couples a combined allowance of £700,000.

What planning is available to those with estates worth in excess of the exemptions outlined above?

If you can afford to do it, you may give away assets, providing you survive seven years after the gift the gift is exempt. Be aware that giving away an asset rather than cash may well create a capital gain and a different kind of tax liability.

Luckily, the work E-mail is much faster than the access at home. Besides, who can get to the home computer with the kids and teens hogging it all night and day?

Whoops ... here comes the boss. Quick! Minimize the screen! Phew! That was close. Now back to [fill in the blank with whatever fad site or online community calls your name]. Do you hear it? "Parry," it calls, "your Neopet needs to be fed." "Check the lineup for your fantasy football team," "What is your account balance? Did you pay the Visa bill this month?" "Have you checked your horoscope to see if you'll be having a good day?" "Hmmm, that cruise you always wanted to go on may be on sale at LuxuryLink.com." "That motorcycle auction oneBay (NSDQ: EBAY) closes today." "Maybe your soul mate finally saw your profile on Match.com." "Your Friendster private circle calls." It's hard to focus on work when our personal lives beckon so frequently and can be addressed via the Internet so easily.

Never before have employees been so excited to get to work and focus all of their attention on their computer screens. But what passes for enthusiasm in the workplace is often an enormous waste of an employer's money. Some studies estimate that employers are losing up to $50 billion annually in wasted employee time and resources online. Others believe that number is seriously understated.

Management experts have estimated that only about 67% of any employee's workday is actually productive (without factoring in personal use of the Internet). The typical productivity losses range from coffee breaks to downtime while changing tasks to lack of organization. But with the advent of music downloading, online shopping, auction sites, and fantasy sports, that percentage is reduced quickly and radically.

Instant messaging, always on, carries messages from others also wasting time at work. Communications that never would have been made during the workday, given the ease and instantaneous gratification of a reply, are made all day long.

The sites that eat up productivity at work include eBay (you name it, you can find it on eBay), travel sites (where employees can plan their vacations, usually at a discount), E-commerce sites over the holidays, car-shopping and price-comparison sites, pornography, fantasy sports, horoscopes, banking, investment and stock-watch sites, cyberdating services, and, to rub salt in the employer's wound, job-hunting sites. Some of the newest rages online catch on first in the workplace. It's a matter of faster access and fewer interruptions than at home. And where downloading full-length movies and lots of music files are concerned, endless storage capacity on the network's servers.

So how is an employer supposed to reduce cyberloafing? Some have gone cold turkey and cut off Internet access and E-mails altogether. But most experts believe that cutting off Internet access is throwing the baby out with the virtual bathwater. Along with the wasted time comes improved productivity when the Internet is used as intended. Many studies have been conducted in which employees have indicated that they would sooner give up the phone than E-mail at work.

Some employers have opted for software to monitor employees' surfing activities and in some cases restrict their online activities. Most have adopted acceptable-use policies, and it's reported that 22% of employers have terminated employees because of violations of those policies. Others have restricted Internet access to those employees who require it for their work, limiting nonessential access. (Does every clerk in your mailroom really need surfing capability?)

There are even outsourcing companies that manage oversight for you. But what's really working? And what's the best way to get the employees to resist the call of the Internet and personal instant and E-mail messaging? And which online activities and sites are the most addictive? It's a little of "one from column A and two from column B." Knowing what your employees are doing, and how much time they're spending doing it, will help you find solutions that work for you.

Before you can forge a solution, you need to understand the scope of the problem. Do your homework:

# Who has access to the Internet/E-mail and instant messaging at work?

# Do you have a workplace acceptable/Internet use policy? What does it say about personal use of the Internet?

# What monitoring practices are in place, if any, that check if employees are using the Internet for personal surfing?

# Do you block access to certain popular time-wasting sites, such as job-hunting, investment, cyberdating, gaming, and auction sites?

# What do you do when you discover an employee has breached the permitted-use policy?

# Are certain personal uses more objectionable to you than others?

# Is personal Internet use permitted as long as the employee is otherwise productive?

# Do you monitor other electronic communications, such as phone calls?

# Do you have the IT ability to block access to certain sites or applications? Are you using the blocking technology? Who decides which sites are blocked and which ones get through?

# Do you have the IT ability to monitor which sites are accessed by employees? Are you using the monitoring technology? Who decides what monitoring is used and when it is used? Who's monitoring the monitors?

# Would your employees object to restricting their Internet use to work-related surfing? Would clamping down on personal Internet use adversely affect your workplace culture?

# Have you conducted efficiency audits? If so, what did they find?

The Privacy Lawyer: Want The Low-Down On Your Cheating Spouse? Consider That You May Be Breaking The Law

The virtual fly on the wall ... how tempting it would be to read others' E-mails. And many of us give in to that temptation! Sometimes our emotions outweigh our common sense and we find ourselves "telling it to the judge."

What can we do, and what should we do? What's the difference between monitoring employees' surfing and electronic communications and snooping if you suspect that your significant other is cheating? When are E-mails off-limits? Can you read their E-mails if you think your partner is doing some business on the side, or that your assistant is looking for a new job? Can you read your kids' E-mails if you worry that they're talking to strangers online? What about your spouse's ex's E-mails if you're involved in a custody battle for the children?

That's exactly what got Angel Lee into trouble when she wanted to know more about what her spouse's ex was saying in her E-mails. And this month she was sentenced to a 60-day home detention by Judge Richard Matsch (the Colorado federal district court judge who oversaw the Oklahoma City case). Using the logon name and password she had obtained without authorization, she accessed the former wife's E-mail account, reading at least 215 E-mails. The snooping was instigated by a very heated divorce and custody case. Ms. Lee pleaded guilty in March of this year, and the sentencing was delayed until now. Judge Matsch, known for being a tough, "no-nonsense" judge, opted for an in-home detention because of the children living with Ms. Lee. While criminal prosecution of these kinds of cases is rare, I suspect that we'll see substantial increases over the next few years. As more people use the Internet for communication, and resources and software applications become more readily available teaching you how to spy on others online, this will become a serious problem. Some think it is already.

Divorce lawyers around the United States see online communications as a fruitful source of evidence of infidelity and wrongful conduct. They also see it as a serious risk for their clients who have been accused of infidelity and wrongful conduct. Private investigators who used to travel with cameras in hand staking out hotel rooms now do their stakeouts in cybertime from computer terminals.

In my role as executive director of WiredSafety.org, the world's largest online safety and help group, I receive hundreds of requests weekly from spouses, people involved in faltering romantic relationships, and even other lawyers seeking legal methods of cybersleuthing. As a privacy lawyer, my answer is always the same. "Not everyone we suspect of cheating is always cheating. If you snoop and the other person finds out, there's very little chance you can salvage trust or even the relationship. If you are going to move ahead anyway, tread carefully ... the laws are complicated and broad. While you may find out information about your spouse or girlfriend, you may also find yourself violating the wiretapping laws. And whatever 'evidence' you do find may not be admissible in a court of law. Finally, what is good for the goose is good for the gander ... so look out for someone trying to spy on you!" (Whew! My kids tell me my lectures to people who ask me about this online are second only to my lectures to them...)

The prime law in this area is the Electronic Communications Privacy Act of 1986, an amendment to Title III of the Omnibus Crime Control and Safe Streets Act of 1968 commonly known as the federal "wiretap law." There are also similar state laws, most of which mirror the ECPA. The ECPA was adopted initially to govern third-party interceptions of electronic communications, not to govern a boyfriend's right to access his girlfriend's E-mails. It provides civil and criminal penalties for any person who intentionally intercepts, uses, or discloses "any wire, oral, or electronic communication." Electronic communication is defined as "any transfer of signs, signals, writing, images, sounds, data, or intelligence of any nature transmitted in whole or in part by a wire, radio, electromagnetic, photo-electronic, or photo-optical system that affects interstate or foreign commerce...."

The ECPA also prohibits the use or recitation of information obtained from any interception. Most of the cases developed under the ECPA involve wiretapping of telephone and E-mail communications by law enforcement. Civilly, most of the case law, until recently, involved telephone monitoring. Under the ECPA, though, the owner of the communication equipment and services can usually monitor activities from that equipment. And in the marital setting, the courts have generally refused to review unauthorized access of the spouses' electronic communications. (This unwillingness to review possible violations probably wouldn't apply to people merely living together or involved in a relationship and not living together.)

In certain states where they exist, the person being spied upon may be able to seek relief under the common-law tort of invasion of privacy. Although many state courts have held that no such tort exists, the tort generally requires an intentional intrusion, "physical or otherwise, upon the solitude or seclusion of another upon his private affairs, or concerns ... if the intrusion would be highly offensive to a reasonable person."

The Privacy Lawyer: What To Do Before The RIAA Knocks

The Recording Industry Association of America is taking dramatic steps to protect its copyrights against free file sharing, and it hasn't ruled out serving subpoenas on companies and universities that offer E-mail and Internet access to employees and students if it suspects that they use those systems to pirate material. So what do you do if worse comes to worst and the RIAA knocks?

Check your privacy policies. What do you say is done with data collected from users at your sites? What do they say you do with the data? Do you have a legal-process exception, and does the exception state that you comply with court orders? Have your privacy lawyers review the language. Are you subject to confidentiality agreements that might be affected by a demand for user information?

Call your data-management contractor. What protections do you have if it's served with a subpoena? Review the contract, and make sure it provides for legal-process exceptions and for sufficient advance notice to you if it's served before your contractor complies.

If you're managing others' data, make sure you're indemnified for complying with a 512(h) subpoena, which can be used to obtain the identities of everyone sharing music online. If you belong to a privacy program like Trust-e, make sure that complying with a 512(h) subpoena doesn't violate its policies. Check with counsel in advance about what information you maintain and how it's collected, stored, and accessed. You don't have to give up data you don't have. Don't collect what you don't have to. If there isn't a valid business purpose for it, the risks will always exceed the benefits of keeping it.

If you are subject to the Children's Online Privacy Protection Act, don't respond to a subpoena unless you get knowledgeable advice. Any response to the 512(h) subpoena in connection with a child under the age of 13 may violate the act, which carries legal consequences.

Talk to your privacy professionals to see if health, securities, or financial-privacy regulations are relevant when complying with a subpoena and make sure your human-resources team knows these issues.

Make sure your data- or Internet-related insurance cover good-faith compliance with a 512(h) subpoena.

This is a substantial reduction from the potential damages of millions or even billions of dollars if a lawsuit had been successful.

The state must respect, protect, promote and fulfil the rights in the Bill of Rights.

The rights in the Bill of Rights are subject to the limitations contained or referred to in section 36, or elsewhere in the Bill.

Application:

The Bill of Rights applies to all law, and binds the legislature, the executive, the judiciary and all organs of state.

A provision of the Bill of Rights binds a natural or a juristic person if, and to the extent that, it is applicable, taking into account the nature of the right and the nature of any duty imposed by the right.

When applying a provision of the Bill of Rights to a natural or juristic person in terms of subsection (2), a court in order to give effect to a right in the Bill, must apply, or if necessary develop, the common law to the extent that legislation does not give effect to that right; and may develop rules of the common law to limit the right, provided that the limitation is in accordance with section 36(1).

A juristic person is entitled to the rights in the Bill of Rights to the extent required by the nature of the rights and the nature of that juristic person.

Property Rights in South Africa:

No one may be deprived of property except in terms of law of general application, and no law may permit arbitrary deprivation of property.

Property may be expropriated only in terms of law of general application for a public purpose or in the public interest; and subject to compensation, the amount of which and the time and manner of payment of which have either been agreed to by those affected or decided or approved by a court.

The amount of the compensation and the time and manner of payment must be just and equitable, reflecting an equitable balance between the public interest and the interests of those affected, having regard to all relevant circumstances, including the current use of the property; the history of the acquisition and use of the property; the market value of the property; the extent of direct state investment and subsidy in the acquisition and beneficial capital improvement of the property; and the purpose of the expropriation.

For the purposes of this section:

The public interest includes the nation's commitment to land reform, and to reforms to bring about equitable access to all South Africa's natural resources; and property is not limited to land.

The state must take reasonable legislative and other measures, within its available resources, to foster conditions which enable citizens to gain access to land on an equitable basis.

A person or community whose tenure of land is legally insecure as a result of past racially discriminatory laws or practices is entitled, to the extent provided by an Act of Parliament, either to tenure which is legally secure or to comparable redress.

A person or community dispossessed of property after 19 June 1913 as a result of past racially discriminatory laws or practices is entitled, to the extent provided by an Act of Parliament, either to restitution of that property or to equitable redress.

No provision of this section may impede the state from taking legislative and other measures to achieve land, water and related reform, in order to redress the results of past racial discrimination, provided that any departure from the provisions of this section is in accordance with the provisions of section 36(1).

These are necessary to ensure that condominiums are properly operated and maintained, and to define the rights and obligations of the individual owners.

Some rules regarding the individual owners, condominiums may have restrictions regarding the number of occupants per unit, the age of occupants, pets, noise, and parking and when certain amenities such as the swimming pool, tennis court, etc. may be used.

As well many condominiums have strict rules concerning the alteration of the unit space or its appearance. Additionally, you may have to get the permission from the condominium’s Board of Directors before you do the following: change exterior fixtures, install a satellite dish, put up new colored drapes, install an conditioning unit in one of the windows, and in particular make changes that may affect the premise’s structure or safety.

As an individual condominium owner you may be obliged to attend condominium meetings or serve on condominium boards and committees. New South Carolina Franchising Law

Local Governments No Longer Authorized to Issue Franchises
Pursuant to a bill enacted May 23, 2006, counties and municipalities (“Local Governments”) in South Carolina no longer have the authority to issue cable franchises. New franchise applications must now be directed to the Secretary of State.

Local Governments may continue to enforce existing franchise agreements until their expiration. Incumbent franchise holders will likewise remain subject to their existing franchise agreements and cannot avail themselves of a state-issued certificate of franchise authority in areas subject to a Local Government franchise until expiration of such current agreements. That said, the new law does permit incumbents to opt out of such franchises at any time on or after the date that the holder of a state-issued certificate of franchise authority provides notice of service commencement. Additionally, incumbent cable operators may seek authority under the new law to provide services in areas where they are not subject to a current franchise agreement.

Applications for a state-issued certificate of franchise authority must be accompanied by an affidavit and signed by an officer or general partner of the applicant containing the following:

(1) affirmation that the applicant agrees to comply with all applicable federal and state laws and regulations;

(2) a written description of the municipalities and unincorporated areas of counties to be served, in whole or in part, by the applicant, which must be amended by the applicant before the provision of cable service within an area not described in a previous application or amendment; and

(3) the location of the principal place of business and the names of the principal executive officers of the applicant. Holders of a state-issued certificate of franchise authority seeking to expand into new service areas must file amended applications with the Secretary of State identifying the new service areas to be served.

Procedure
The Secretary of State must notify each affected Local Government of its receipt of the application or amended application within five days of its receipt. The notification will request the franchise fee rate to which the incumbent cable operator is subject, the number of activated PEG access channels and whether it consents to the grant. There does not appear to be any requirement that notice be provided to the incumbent cable operator.

Local Governments then have 65 days to respond and must provide an explanation if they seek to deny consent. Where a Local Government responds and does not object, a franchisee must be issued a certificate of franchise authority within 80 days of the request for information with the same franchise fee and PEG access obligations as the incumbent.

Where Local Governments fail to provide the requested franchise fee rate and PEG access information, the statute automatically imposes a franchise fee rate of 2% of gross revenue and absolves the applicant of any requirement to provide PEG access.

If a Local Government denies consent or does not timely provide its unconditional consent, the application will be denied. The only remedy from such a denial is to seek relief under state or federal law in state or federal court.

No Build-Out Requirements
Service under a state-issued certificate of franchise authority must begin to be deployed in each of the areas described in an application within one year of the date of the issuance of the certificate or the certificate becomes null and void.

The statute specifically provides, however, that the foregoing service commencement requirement “shall not be construed to require deployment of service throughout the municipalities or the unincorporated areas of the counties described in [the application]” and later specifically prohibits the imposition of build-out requirements. Accordingly, the statute lacks any build-out requirements.

The statute does, however, prohibit state certificated franchisee’s from denying access to service to any group of potential residential subscribers “because of the income of the residents in the local area in which the group resides.” The statute further provides that “cost, density, distance and technological or commercial limitations must be taken into account” in determining whether a violation of the redlining prohibition has occurred. State issued certificate holders are granted “a reasonable time to deploy … service.” Those who believe they have been denied access to services may file a complaint with the Secretary of State.

Conclusion
While the statute does contain franchise, requirements, PEG requirements and customer service requirements – it requires compliance “with all applicable federal customer service requirements” – the statute does not speak to a number of issues common to franchise agreements. For example, the statute makes no provision for bonding requirements or institutional networks.

Additionally, state-issued certificates of franchise authority are also “fully transferable.” Other than the requirement to submit a notice of transfer with the Secretary of State and the affected Local Governments within ten days of the completion of the transfer, there is no obligation to obtain consent to the transfer. Though muscle damage, sometimes debilitating muscle pain and disintegration, is the most common side effect, statins have been found to cause many other serious adverse effects. Patients taking Lipitor have had a higher incidence of cancer, neuropathy, heart failure, dizziness, memory failure, and depression. The extent of these problems is far greater than anybody realizes because doctors often diagnose these side effects as problems relating to the original risk of heart disease, not the drug prescribed to treat it.

If you are taking Lipitor or another statin and develop muscle weakness or pain, stop taking the drug immediately. If you have strange side effects that doctors cannot seem to diagnose, it could be related to the statins. Above all, if you chose to take these drugs, take Co-Q10 supplements. This is an important liver enzyme whose production is blocked along with cholesterol. If you are suffering adverse effects from these popular drugs, add your voice to the public outcry of statin victims so that doctors, drug companies, and the FDA realize the extent of the problem. Lotronex Lawyer

Even in clinical trials, Lotronex displayed a tendency towards causing ischemic colitis in patients. From the February in which Lotronex was approved until June, the FDA received seven reports of serious complications of constipation leading to hospitalization. Surgery was required to relieve some cases of extreme Lotronex constipation. Lotronex Medication Guides were issued under regulations that became effective in 1999 when Lotronex patients ended up in hospitalization and requiring surgical procedures for constipation. Since Lotronex is a drug used to treat diarrhea, these surgeries were obviously not necessary to treat conditions held before taking the drug.

Despite the FDA’s issuing of this safety information about Lotronex, patients kept filing severe adverse event reports of ischemic colitis, complications of constipation, death reports, and complications requiring blood transfusions. The FDA recalled Lotronex on November 2000, just nine months after approval.

In 2002, the FDA announced the approval of a supplemental New Drug Application that allows restricted marketing of Lotronex to treat only women with severe diarrhea-predominant irritable bowel syndrom. The approval of Lotronex includes a risk management program to ensure patients and physicians are fully informed of risks and possible benefits of Lotronex. Patients using Lotronex must sign a contract with their doctors stating that they understand the risk of serious constipation that could result in surgery, blood transfusion, or death.

These restrictions are very tight because of the history of tragedies involving Lotronex and its potential to cause unusual, very painful death by constipation. Because of this it is imperative that Lotronex not be bought over the internet. The system through which patients sign a Lotronex contract with their doctor assures that everybody involved in the transaction is educated on all the dangers and benefits involved and prepared to accept responsibility for the consequences.

Lamicil Tablet Side Effects Lawyer

While the recent Lamisil commercial featuring Digger, a disgusting cartoon fungus, is still fresh in our mind (who could forget the imagery of a toenail being pulled back and colorful germs crawling in?) it is a good time to look at the side effects of this seemingly innocuous drug. Despite the disturbing advertising campaign, who would have guessed that an antifungal tablet could have so many negative side effects?

The drug comes in both cream and tablet form and is used to fight nail fungus, athlete’s foot, jock itch, and ringworm. It can also be used to treat tinea veriscolor, an infection that produces brown, tan, or white spots on a person’s torso. Lamisil tablets do not work right away, and the full result cannot be seen for months. Perhaps it is this necessarily long exposure period that contributes to the worst of Lamisil’s side effects. The exact side effects resulting from Lamisil cannot be anticipated because the possibilities are so diverse. Inform a doctor of any suspected side effects as soon as possible.

Lamisil tablets have been found to cause diarrhea, indigestion, rash, abdominal pain, gas, hives, itching, nausea, taste disturbances, vision problems, fatigue, flue, hair loss, joint pain, liver problems, aches, and vomiting. Vision problems resulting from Lamisil tablets have been diagnosed as serious changes and possible damage to the retina of the eye. Lamisil tablets can cause rare, possibly fatal liver disease and, in rare cases, caused severe skin reactions. Stop using Lamisil immediately if you develop a skin rash and call your doctor immediately, as these too can be fatal. Lamisil has not been tested safely on children, nor should it be used by pregnant women or women who are breast feeding.

The Privacy Lawyer: Mad as *&%$ And Not Gonna Take It Anymore!

Sometimes I get more than 1,000 a day. (If you add the spam, I get about 3,000 a day.) I guess that gives you a clue about one of my pet peeves ... spam!

Then again, when traveling and having to access E-mail from my hotel, I hate dial-ups! (I was in Auckland, New Zealand, last week and had 22,000-Kbps dial-up access at $1.12 per minute. It took four hours to download my E-mails and five minutes to send a quick text-only E-mail.)

But perhaps having to use Web-access for my EarthLink(ELNK) E-mail account annoys me even more. With anything other than clean broadband, the loading of the banner ads with cute little animations takes more time and bandwidth than I have. I hate EarthLink's Web-access for E-mail! I also hate cute little banner ads that hog my bandwidth!

I hate pop-ups, too! I also hate pop-unders and anywhere else they want to insert a pop-whatever! While we're at it, I hate Viagra ads and penis-enlargers and Paris Hilton video promotions. I hate spoofed E-mails and attempts to phish my financial information. I hate unsolicited instant messages pretending to be from someone I know.

I hate that when I mistype, I end up at a site I didn't want to visit. I hate search-engine results that are loaded with keyword purchases and don't give me what I want. I hate the fact that a large percentage of my E-mails are never delivered to or from me. I hate that I can't open an attachment without worrying that it's either a Trojan horse or a virus or some new kind of malicious code. I hate that my Palm Pilot is now at risk for viruses and that I'm getting porn ads on my cell phone. I don't like being tracked without my OK, or in-my-face porn, unless I'm looking for it.

I hate it when I type in the wrong URL and end up on some directory site that slams my home page, changing it to the directory page. I hate that game and cheat-code sites have so many spyware downloads and don't first get my permission. I hate that they try to pretend that my clicking on the "OK" for their terms of use or licensing agreements is an OK for installing a download. I hate that I can't getMicrosoft( MSFT)'s Messenger program off of my computer without manually editing my registry!

I hate that kids are being sued for downloading music without authorization, but Apple and others are selling MP3 players with 10,000-song capacities! (Know anyone who has that many "legal" songs?) I hate that our kids are expected to "ignore" or "just delete" violent hard-core porn or hate messages. I hate that wireless is so unsecure! I hate when Windows tells me I need their XP disc to add or remove something! (I hate when any software makes me look for the install discs!)

I hate laptops with touchpads that screw up everything I type when my finger brushes against the touchpad, or I breathe, or I swallow, or I hear a sound, or a tree falls in the woods and no one is there.

I hate that I can't book a hotel on Priceline(PCLN).com on the same day I need the room, or the day before. I hate that my favorite travel auction site doesn't have a bid proxy application, and I have to keep checking back and manually update my bid. I hate that so many people are selling counterfeit goods online, especially to my daughter oneBay( EBAY).

I hate the fact that my hotel (claiming to have wireless broadband throughout the hotel), doesn't have it in my suite, apparently. And now I'm sitting and typing at the front desk, barefoot, happy that I am one of a mere few guests and can sit here undisturbed, and I've finally found where I can get wireless (or anything other than the 22,000 dial-up I found in Auckland). I hate that the hotel can advertise that they have wireless broadband everywhere, and I'm forced to sit here in the lobby at 4:15 a.m.

I hate that ranting maniacs often are the only ones posting on my favorite listservs. I hate the noise that disrupts all the good things online. I hate when I finish the best column I've ever written, or the first chapter of my new book, that my wandering thumb, or breath, or the tree falling in the forest strikes, and it's deleted and my backup didn't pick it up. I hate when I misaddress a personal E-mail and my landscaper has to tell me that he's sure that my passionate E-mail was intended for someone else, otherwise he had underestimated how important my flower beds are to me.

I hate that I need five rechargers when I travel: one for my Palm, one for my BlackBerry, one for my cell phone, one for my MP3 player, and one for my computer. I hate that when I remember to bring my plane computer-charger adapter, the plane doesn't have powered seat outlets. I hate that when I don't bring it, everyone else is typing away and playing games and using the outlets I can never find when I need them. I hate when I remember my adapter and the plane has outlets that I always forget the tip that fits this laptop.

It's funny how much I hate these things, but I could never live without the Internet or portable computing. It's clearly a love/hate relationship. What about you? What do you hate? The Privacy Lawyer: Actions Must Follow Privacy Mea Culpas

First JetBlue Airways, then Northwest Airlines, and now American Airlines. Each has admitted sharing passenger information with government agencies or companies associated with agencies. Passenger-name records typically include itinerary, name, address, phone number, and credit information. They also may include E-mail addresses and flight preferences (such as kosher meals). Much of this is sensitive to consumers and subject to strict laws overseas. Now all three airlines face class-action lawsuits and potential federal sanctions for releasing the information without passengers' consent or legal process.

Sharing data in the interest of security is understandable. Frankly, I find it surprising that only three complied when asked for personal information to study risk-assessment tools. I suspect more airlines will come forward in time.

JetBlue's was the first shoe to drop, last September. The airlines gave data to Torch Concepts, a would-be defense contractor. Five million JetBlue passenger-name records, involving 1.5 million passengers, were involved. These records were later matched with data purchased by Torch from Acxiom, JetBlue's data aggregator, which included income, occupation, home ownership, and Social Security numbers.

The data was used in a report Torch presented at one of its conferences, and a chart was posted online. It contained personal data belonging to a specific, nonconsenting passenger. That information stayed on the site for about six months, until discovered by privacy advocates in September. JetBlue admitted that the disclosure violated its privacy policy in effect at that time.

In January, Northwest said that beginning in December 2001, it had given passenger name records (involving more than 10 million passengers) for two months to NASA. Again, the data was used for a study of risk assessment. Northwest denies violating its privacy policy.

And now American says it gave passenger-name records affecting 1.2 million passengers to four companies seeking contracts with the Transportation Security Administration in June 2002.

The trio, which seem to have learned a lesson, insist that the volunteered data either has been destroyed or returned by the recipients. Each says it won't give records for tests of the government's proposed Computer Assisted Passenger Prescreening System, a nationwide computer system designed to assess risks, unless compelled to do so. Wise move, legally speaking. All companies, no matter how much they would like to help, should insist on a formal, legal demand before giving up private consumer data (see "Patriotism, Compliance, And Confidentiality," Oct. 20).

I suspect that there are more examples like these. All companies should audit post-Sept. 11 data disclosures to uncover mistakes, and ensure that any records disclosed are now secure and that affected consumers are notified.

Finally, I would caution that hindsight is always 20/20. While doing all we can to protect personal and private information, we also should remember the national atmosphere in the immediate aftermath of Sept. 11, 2001, and not be too quick to indict well-intentioned actions, no matter how unwise. It was a difficult time for all, not least of which the airlines.
